Terms & Conditions – ADT & JCB Machine Rental

These Terms & Conditions apply to the rental of Articulated Dump Trucks (ADTs), JCB Loaders, Backhoe Loaders, and related machinery (“Equipment”) provided by [Your Company Name] (“Lessor”) to the client (“Lessee”). By renting our equipment, the Lessee agrees to the following terms:

1. Rental Period

The rental period begins on the date the equipment is delivered or collected and ends on the agreed return date.

Extensions must be requested in writing and are subject to availability and additional charges.

2. Rental Rates & Payment

Rental charges are based on daily, weekly, or monthly rates as agreed in the rental contract.

Payment terms must be honored as per the invoice issued. Late payments may attract interest charges.

Fuel, operator (if not included), transport, and other operating costs are the responsibility of the Lessee unless otherwise agreed.

3. Delivery & Collection

Equipment delivery and collection can be arranged by the Lessor at an additional cost.

The Lessee is responsible for ensuring proper access to the site for delivery and operation.

4. Equipment Use

The Lessee shall use the equipment only for lawful purposes and within its designed capacity.

Equipment must be operated by qualified and licensed operators.

The Lessee is responsible for maintaining the equipment in good working condition during the rental period.

5. Damage, Loss & Insurance

The Lessee assumes full responsibility for any damage, theft, or loss of the equipment during the rental period.

Any damage caused by negligence, misuse, or overloading will be charged to the Lessee.

Insurance coverage for the equipment, site, and operators is the responsibility of the Lessee unless otherwise agreed in writing.

6. Maintenance & Repairs

Routine maintenance and servicing are the responsibility of the Lessor.

Any repair costs arising from misuse or negligence will be charged to the Lessee.

7. Liability

The Lessor is not liable for any direct, indirect, or consequential loss, delay, or damages arising from the use or breakdown of the equipment.

The Lessee indemnifies the Lessor against any claims, damages, or injuries to third parties arising from the equipment’s use.

8. Termination

The Lessor reserves the right to terminate the rental agreement and repossess the equipment if the Lessee breaches the terms or fails to make payments.

Early termination by the Lessee may result in additional charges.

9. Governing Law

These Terms & Conditions are governed by and construed under the laws of [Your Country/Region].

Any disputes shall be resolved under the jurisdiction of the local courts.
